Terms of Use for Our_Group

1. Acceptance of Terms

Welcome to Our_Group. By accessing or using our mobile application (“App”), you agree to comply with and be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you must stop using the App immediately.

These Terms apply to all users of the App, including but not limited to visitors, registered users, and contributors. By continuing to use the App, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

2. Description of Service

Our_Group is a platform designed to bring people together to form groups and save collectively toward shared financial goals. Users can select from various contribution methods to suit their group’s needs.

We reserve the right to modify, suspend, or discontinue the App or any feature at any time without notice or liability to you.

3. User Eligibility

By using the App, you confirm that you:

• Are at least 18 years of age;
• Have the legal capacity to enter into these Terms;
• Are not prohibited by law from using the App;
• Meet any additional eligibility requirements imposed by third-party providers, such as Stripe, including minimum age requirements;
• Agree to provide accurate, current, and complete information during the registration process and to keep your information updated.

To access certain features of the App, you must register and create an account. You agree to:

• Provide accurate, truthful, and current account information.
• Keep your account login details confidential and secure.
• Notify us immediately if you suspect any unauthorized use of your account.

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized use of your account due to your failure to maintain the confidentiality of your account details.

5. Contribution Methods

Our_Group offers several contribution methods, including:

1. Equal Contributions: All group members contribute an equal amount toward a shared goal.

2. Percentage-Based Contributions: Group members contribute based on a predetermined percentage.

3. Open Contributions: Group members can contribute any amount during a specific period.

4. Rolling Contributions: Contributions continue indefinitely with no end date.

5. Round Contributions: Each member receives contributions from the group on a rotating basis.

Your participation in any contribution method is voluntary, and you are responsible for fulfilling your agreed contributions.

6. Fees and Charges

We may charge fees for certain services, including transaction fees, subscription fees, or service fees. These fees will be clearly communicated to you prior to any charge being made. By using the App, you agree to pay any applicable fees and charges. In addition to fees charged by Our Group, third-party processors like Stripe may impose their own transaction or service fees. These fees, if applicable, will be communicated to you before the transaction.

We reserve the right to change our fees at any time, and any fee changes will be communicated to you in advance.

7. Payments and Transactions

By making payments or contributions through the App, you authorize us or our third-party payment processor to process transactions on your behalf. You agree to provide valid payment information and authorize all charges incurred in connection with your use of the App. Payments and transactions made through the App are processed securely by our primary payment processor, Stripe. Stripe manages the payment processing on our behalf and complies with PCI DSS standards to protect your payment information.

We are not responsible for any failed or declined transactions due to insufficient funds, inaccurate payment information, issues with Stripe or issues related to your financial institution.

8. User Conduct

You agree not to engage in any of the following prohibited activities:

• Violating any local, state, national, or international laws;
• Uploading or transmitting harmful content, including malware, viruses, or any other harmful code;
• Engaging in fraud, including misrepresentation of identity or financial information;
• Using the App to harass, abuse, or harm another individual or group;
• Attempting to interfere with or disrupt the operation of the App or our systems;
• Using any automated means to access the App without permission (e.g., bots, scraping, etc.);
• Impersonating another person or entity.
• Providing false or misleading information for identity verification or payment processing purposes, which may result in delays or account limitations;
• Users must comply with all applicable local, state, national, and international laws and regulations when using the App.
• Users may not engage in activities restricted by Stripe’s Acceptable Use Policy, including those prohibited by Stripe’s Prohibited and Restricted Businesses list.

We reserve the right to suspend or terminate your account if we determine that you have violated these Terms or engaged in any unlawful or prohibited activities.

9. Intellectual Property

All content and materials available on the App, including but not limited to text, graphics, logos, images, and software, are the intellectual property of Our_Group or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You agree not to reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any of the content without prior written permission from us.

10. Limitation of Liability

To the fullest extent permitted by law, Our_Group, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from or in connection with your use of the App, even if we have been advised of the possibility of such damages.

Our_Group is not responsible for issues, disruptions, or damages resulting from third-party services, including payment processors such as Stripe. Any issues or errors arising from Stripe’s processing should be addressed directly with Stripe, as Our_Group is not liable for third-party service outcomes.

We make no representations or warranties of any kind, whether express or implied, regarding the App or its content. Your use of the App is at your own risk.

11. Termination

We may terminate or suspend your account and access to the App at our sole discretion, without notice or liability, if you violate these Terms or engage in activities that are harmful to the App or its users.

Upon termination, your right to use the App will immediately cease. Any provisions of these Terms that, by their nature, should survive termination will survive, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

12. Indemnification

You agree to indemnify and hold harmless Our_Group, its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, or expenses (including reasonable attorney’s fees) arising out of or related to:

• Your use of the App;
• Your violation of these Terms;
• Your violation of any third-party rights, including but not limited to intellectual property or privacy rights.

13. Modifications to the Terms

We may update these Terms from time to time in our sole discretion. If we make material changes, we will notify you by posting the updated Terms within the App or by email. Your continued use of the App after any changes to the Terms signifies your acceptance of the updated Terms.

It is your responsibility to review the Terms periodically for any updates or changes.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [Your Country/State], without regard to its conflict of laws provisions.

• Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Our_Group regarding the use of the App.
• Waiver and Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
• Assignment: You may not assign or transfer these Terms or your rights and obligations hereunder without our prior written consent. We may assign or transfer these Terms at our discretion without restriction.
• We may update these Terms from time to time in our sole discretion. Significant changes will be communicated to you by posting the updated Terms within the App or by email. Your continued use of the App after any changes to the Terms signifies your acceptance of the updated Terms. It is your responsibility to review the Terms periodically for any updates or changes
• Data Collection and Use: By using Our_Group, you consent to our collection and use of your personal data for identity verification, compliance, and to improve user experience.
• Third-Party Sharing: We may share your data with trusted third-party partners, including Stripe, solely for processing payments and ensuring compliance with security standards.
• User Consent: By using the App, you explicitly consent to our collection, processing, and sharing of your data, as described in our Privacy Policy, including sharing with third-party service providers where necessary for operational purposes.
